These general terms and conditions ("Terms") apply when you as a consumer ("You") place an order via www.latalia.se, Agreement is concluded between you and Latalia AB, organization number 559230-3449
LATALIA follows distance trading rules and regulations.
To shop with us you need to be 18 years old. From the age of 16 you can shop with us if you shop together with or with the approval of a guardian. We reserve the right to final sale of goods. All attempts at fraud are reported to the police. We reserve the right to cancel a purchase if fraud is suspected.
LATALIA reserves itself for possible typographical errors in texts on this website. We do not guarantee that all images accurately reflect the actual appearance of the products. However, we always strive to reproduce as similar a picture of the product as possible. If an incorrect price has been entered for an item you have ordered, LATALIA will of course notify you of this and await your approval of the corrected price before LATALIA continues with the order.
An order confirmation is sent out via email when you have completed your order. There you will find information about what you bought with prices, shipping costs. If something is wrong with the order, please contact us asap at email@example.com.
2. AGREEMENT AND ORDER
A purchase agreement is only entered into when LATALIA has confirmed your order and you have received order confirmation from LATALIA via the e-mail you entered.LATALIA invites you to save this order confirmation in case of any questions or need to contact LATALIA's customer service.
3. PRICES, FEES AND PAYMENT
When ordering via the Site, the prices stated on the Site apply. Prices are stated in Swedish kronor and include VAT. Prices do not include payment and shipping fees, which are listed separately.
You can pay in the ways indicated on the Site. Read more about our payment methods and discounts here. LATALIA has the right to charge already in connection with the order, unless invoice payment or another similar payment method has been chosen by you and approved by LATALIA. In case of invoice payment or partial payment, LATALIA or its partners may make a credit report. In such case, you will be informed about this.LATALIA reserves the right not to always offer all payment methods, or to change the payment method if the one you have chosen for some reason does not work at the time of the purchase. Please note that any restrictions on payment options are stated on the Site.
Together with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the following payment options where payment is made directly to Klarna:
● Pay within 14 days: Payment time is 14 days from dispatch of the goods. You can find the conditions for paying within 14 days here.
● Account: Klarna Account is an account credit provided by Klarna and which gives the borrower the opportunity to pay in installments for their purchases monthly with at least 1/24 (minimum SEK 50) of the total utilized credit amount or in accordance with those approved at the cash register the conditions. Together with Shopify Payments we offer card payment via Mastercard and Visa. There are no additional fees and the money is withdrawn immediately upon purchase.
4. PROMOTIONS AND OFFERS
LATALIA may from time to time offer promotions on the Site that may have more favorable terms than what appears in these Terms, e.g.ex regarding payment or extended right of withdrawal. These more favorable conditions apply for the duration of the promotion and for the specific goods specified by LATALIA in connection with the promotion.LATALIA reserves the right to withdraw such promotions at any time. In the event of termination or cancellation of a campaign, these Terms and Conditions apply without modification. Offers on specific goods on the Site are valid for a limited time and while stocks last.
5. DELIVERY AND TRANSPORT
Goods that are in stock are normally delivered within the number of working days specified on the Site. Unless otherwise specifically agreed (e.g.ex in connection with the booking of goods that are not in stock) the delivery takes place no later than 30 working days from when LATALIA confirms the order in writing through the order confirmation. The expected delivery time of the item is shown in the order confirmation, in the checkout and/or on the item in question. Unless otherwise specifically agreed and a delivery takes more than 30 working days and this is not due to you as a customer, you have the right to cancel the purchase.
If packages are to be redeemed, you must do this within the time specified in the notification. Packages must normally be picked up in person with valid identification and order number. You always receive a notification that shows where and when packages are to be picked up. Notification can take place via e-mail, regular mail and, if you have provided a mobile number, also via phone calls or SMS. If you do not pick up the package, LATALIA has the right to charge you a fee of SEK 290
LATALIA is responsible for goods that are damaged or lost during delivery to you. Claims for transport damage must be made within a reasonable time. When you collect your package, it is therefore important to check that it has not been damaged in transit.LATALIA recommends that you report any transport damage directly on site to the delivery agent and then contact LATALIA's customer service. Remember to keep all packaging and the product's packaging in the event of transport damage. Should you not notice any damage to the package before you get home, you should, before opening the package, take a photo of the damage to the package and contact LATALIA's customer service directly.
6. RIGHT OF WITHDRAWAL
When purchasing goods on the Site, a 14-day right of withdrawal always applies in accordance with current consumer protection legislation. This means that you have the right to cancel your purchase by notifying LATALIA of this within 14 days from when you or your representative received the ordered item (the cancellation period).
The right of withdrawal does not apply to the following types of goods:
goods which have been manufactured according to your instructions or which have otherwise been given a clear personal touch;
goods with a broken seal that cannot be returned for health or hygiene reasons (for example, underwear, cosmetic products, swimwear, hair dryers and similar products, shavers and electric toothbrushes); or
sound or image recordings (eg a CD) or computer program with a broken seal.
In connection with an order for goods for which the right of withdrawal does not apply, you will receive clear information about this. If an item has been sealed, you must not break the seal if you want to be able to exercise your right of withdrawal. The right to regret therefore ends when you break the seal.
If you want to cancel the purchase, you must, before the cancellation period expires, send a clear message to LATALIA at firstname.lastname@example.org. You must enter your name, address and other relevant information, e.g.ex order number and name of the item in the message.
When exercising the right of withdrawal, you pay the return shipping and are responsible for the condition of the goods after you have received the goods and during the return shipping. The product must be returned within 14 days from the date on which notice of the exercise of the right of withdrawal was given to LATALIA. The item must be sent well packaged, in good condition and in the original box. Returns must be made to LATALIA according to the methods.
Sometimes LATALIA may offer free returns for certain items. If free returns apply, it is clear from the current productSajten on the Site.
When you cancel your purchase, LATALIA will refund the amount you paid for the item, including delivery costs. Exceptions apply to any additional delivery costs as a result of you choosing a different delivery method than the standard delivery offered by LATALIA. When part of an order is returned, the delivery cost is not refunded. From the amount to be refunded, LATALIA has the right to deduct an amount corresponding to the decrease in value of the item compared to the original value of the item, if and to the extent that such decrease in value is due to You having handled the item to a greater extent than is necessary to determine its characteristics or function.
LATALIA repays the amount as soon as possible, however no later than within 14 days from the date LATALIA received your notice of exercise of the right of withdrawal.However, LATALIA may wait with the refund until LATALIA has received the item or You have shown that the item has been returned, e.g.ex through a submission receipt. The refund will be made to you via the payment option you chose, provided that nothing else has been agreed or that there are obstacles to such refund.
7.WARRANTY AND COMPLAINT
Some of LATALIA's goods may be covered by warranty. Information about any warranty period and special warranty conditions for each product can be found on the Site or in these Terms and Conditions. Warranty for goods only covers original manufacturing defects, and thus not defects that occur during or after a change in the product's function and appearance, such as rebuilding, upgrading or other configuration of the product. Your order confirmation is valid as proof of warranty.
The right of complaint covers goods that are faulty according to current consumer protection legislation. Customers who wish to claim an error in an ordered item must contact LATALIA as soon as possible after the error is discovered via the contact details provided on the Site. Complaints made within two months from when you discovered the fault are always considered to have been submitted in time. You have a 3-year right of complaint on goods purchased on the Site.
LATALIA is responsible for the return shipping for approved complaints.
Once the complained item has been returned and the complaint approved, LATALIA will compensate you in accordance with applicable consumer protection legislation.LATALIA strives for this to take place within 30 days of LATALIA receiving the complaint, but it may take longer depending on the nature of the goods.LATALIA reserves the right to deny a complaint if it turns out that the product is not faulty according to current consumer protection legislation. LATALIA is not responsible for delays caused by circumstances beyond LATALIA's control such as general labor dispute, war, fire, lightning strike, terrorist attack, change of government regulation, technical problems, failure of electrical/telecommunication/data connections or other communication and errors or delay in subcontractor services due to circumstance specified herein. These circumstances shall constitute a basis for exemption which entails exemption from damages and other penalties. Should any such situation arise, LATALIA will inform you both at the beginning and at the end of the time of the current situation. If the circumstance has lasted longer than two months, both you and LATALIA have the right to cancel the purchase with immediate effect.
10.CHANGES TO THE TERMS
LATALIA reserves the right to make changes to these Terms at any time. Any changes to these Terms will be posted on the Site. Changes apply from the moment you have accepted the Terms (in connection with a new purchase or when visiting the Site), alternatively 30 days after LATALIA has informed you of the changes.However, LATALIA recommends that you keep updated on the Site regularly to be aware of any changes to the Terms and Conditions.
11.APPLICABLE LAW AND DISPUTES
Disputes must primarily be resolved amicably after discussion with LATALIA's customer service.
If the dispute cannot be resolved in agreement with LATALIA's customer service, you as a customer can turn to ARN (General Complaints Board), which you can find more information about at www.arn.se. You can also submit complaints directly online via the European Commission's Dispute Mediation Platform, which you can find via the following link http://ec.europa.eu/consumers/odr. If you submit a complaint via this platform, your case is automatically forwarded to the appropriate nationally responsible dispute resolution body. This dispute resolution body then contacts us and tries to resolve the dispute without court involvement.
In the event of a dispute, LATALIA follows the decision of ARN or the corresponding dispute resolution body.
